These Terms & Conditions (“Terms”) govern your use of the website Ozami.com (the “Website”) and the purchase of digital eCards (“Products,” “eCards,” or “Digital Content”) from us. By placing an order or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use or order from the Website.
1. Who We Are & How to Contact Us
1.1 We operate under the name Ozami, and “we”, “us” or “our” refer to Ozami. “You” or “your” refers to the person using the Website or placing an order.
1.2 Our contact information is:
- Email: hello@ozami.com
- Website: https://ozami.com
We may contact you by email using the address you provided during purchase. “Writing” or “written” includes email communication.
1.3 Age requirement
You must be at least 18 years old to place an order for eCards via our Website.
2. Ordering eCards from Ozami
2.1 How to place an order
To order an eCard:
- Select the desired card and customisation options (message, name, delivery date, etc.) on our Website.
- Provide a valid email address for delivery (your own or the recipient’s).
- Confirm the order by pressing the checkout/confirm button.
- Provide payment using a valid payment method we support.
By placing an order and confirming it, you are making an offer to purchase an eCard under these Terms.
2.2 How and when we accept your order
We accept your order when we send you an order confirmation email. At that moment, a legally binding contract is formed between you and Ozami.
2.3 If we cannot accept your order
We may refuse or cancel your order if, for example:
- there is an error in the price or description;
- payment cannot be authorized;
- a duplicate order is detected;
- the eCard customisation violates our content policy (see Section 4); or
- we are unable to send the eCard for technical reasons.
If we cannot accept your order, we will notify you by email and refund any payment already taken.
2.4 Order reference
Each order will have a unique reference number, which will be included in your confirmation email. Please keep this number for future correspondence.
3. Our Products — Digital eCards
3.1 Nature of Digital Content
The primary Products on Ozami.com are digital eCards — intangible digital content delivered via email or a shareable link.
3.2 Customisation and Customer Content
If you customise an eCard (e.g. by adding a name, message, or uploading images), it is your responsibility to ensure the content is correct (spelling, formatting, correct image, etc.). Once submitted, custom content becomes part of the eCard delivered to you or your recipient.
3.3 Intellectual Property & Licences
By submitting any content (text, images, graphics, etc.) to include in a custom eCard, you grant Ozami a non-exclusive, royalty-free, worldwide license to use, reproduce, adapt, and deliver that content solely for the purpose of fulfilling your order. Ownership of the content remains yours (or the original owner’s).
You must have all necessary permissions and rights for any third-party content you submit. You agree to indemnify us against any claim arising from third-party rights infringement due to your submitted content.
4. Acceptable Content Policy
When customising or submitting content for an eCard, you must not include material that:
- violates intellectual property rights of third parties,
- is illegal, offensive, discriminatory, defamatory, harassing, abusive, obscene, or promotes violence, hatred, or illegal activity,
- impersonates any person or misrepresents identity,
- includes personal data about a third party (e.g. addresses, phone numbers, emails) without their consent,
- violates privacy or data protection rights,
- is otherwise inappropriate or harmful.
We reserve the right to refuse, cancel, or modify orders that violate these standards, without liability to you.
5. Price and Payment
5.1 Price
The price you pay for an eCard will be the price displayed at checkout (including any applicable taxes). We take reasonable care to ensure the price is correct, but reserve the right to correct pricing errors.
5.2 Payment Methods
We accept payment via the methods displayed on the Website at the time of purchase (credit/debit card, digital payment, etc.). Payment is processed at the time you confirm your order.
5.3 Payments Are Final for Delivered eCards
Because eCards are delivered instantly or scheduled for automatic delivery, payment is generally non-refundable once the order is accepted and the eCard is delivered or ready for delivery — subject to the exceptions in Section 6.
6. Refunds, Re-sends & Problem Resolution
Because our Products are digital content delivered instantly, our refund policy is limited. However, we aim to address genuine issues fairly.
6.1 When a refund or re-send may be issued
We may offer a refund or resend the eCard if:
- a technical error on our part prevents delivery or link access;
- duplicate payment or accidental double orders occur;
- an incorrect card is sent due to our system error;
Requests must be submitted within 7 calendar days of purchase.
6.2 Non-eligible situations for refund
Refunds or re-sends are not available for:
- change of mind after purchase;
- incorrect email address provided by customer;
- mistakes in customisation (message, spelling, uploaded image);
- recipient’s failure to open email or link;
- device, browser, or internet issues on customer or recipient side.
6.3 How to request support
To request a refund or re-send, contact us at support@ozami.com with:
- your name and email used to order,
- order reference and date,
- a clear description of the issue.
We aim to respond within 1–3 business days.
6.4 If we cannot fulfil your order
If for any reason we cannot deliver your eCard (e.g. system failure), we will refund you in full.
7. User Account (if applicable)
If Ozami requires or offers user accounts:
- You agree to provide accurate and complete information on registration.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must notify us immediately if you suspect unauthorized use of your account.
We reserve the right to suspend or terminate your account for misuse or breach of these Terms.
8. Limitation of Liability & Disclaimers
8.1 Digital Content Disclaimer
Because eCards are digital products, we cannot guarantee they will display correctly on every device or email client. We are not liable for issues caused by the recipient’s device, network, or email configuration.
8.2 Limitation of Liability
To the fullest extent permitted by applicable law, Ozami will not be liable for any indirect, incidental, special, or consequential damages arising from the use of our Website or eCards, including but not limited to loss of data, loss of business, or emotional distress.
8.3 Indemnification
You agree to indemnify and hold Ozami harmless from any claims, damages, liabilities, costs, or expenses arising from your use of the Website or any content you submit, including any breach of these Terms or infringement of third-party rights.
9. Changes to These Terms & Conditions
We may revise these Terms from time to time. When we do, we will update the published version on the Website. Any changes will apply from the date they are posted. It is your responsibility to review the Terms periodically. Continued use of the Website after changes constitutes your acceptance of the modified Terms.
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the country where Ozami is registered (or operates). Any dispute arising in connection with these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.
